Terms of Use and Subscription
These terms of use define the rules applicable to the access and use of the GotoGo website, application and platform.

2. Purpose of the platform
GotoGo is a digital platform intended to facilitate contact between customers and independent drivers.
The platform allows customers to send ride requests and allows registered drivers to receive, accept or refuse those requests.
GotoGo acts exclusively as a technical intermediary for connecting users and drivers.
3. No transport activity by GotoGo
GotoGo is not a transport company, not a taxi service, not a private hire vehicle service and does not itself carry out passenger transport activities.
Transport services are carried out exclusively by independent drivers registered on the platform, under their own professional responsibility.
GotoGo does not provide transport services, does not own the vehicles used by drivers and does not employ the drivers registered on the platform.
4. Ride prices
GotoGo does not determine the final price of rides carried out by drivers.
Prices that may be displayed in the application or on the website are provided for information purposes only, in order to help the customer and the driver estimate the cost of a ride.
The driver remains free to determine his or her own fare, in compliance with the legislation applicable to his or her activity.
5. Payment for rides
GotoGo does not collect the price of rides carried out by drivers.
Payment for the ride is made directly between the customer and the driver, using the payment methods agreed between them.
GotoGo does not take any commission on the amount paid by the customer to the driver.
6. Customer account
The customer user undertakes to provide accurate information when registering and when using the platform.
The customer undertakes to use the platform in a respectful, fair and lawful manner, in accordance with its purpose.
Any abusive, fraudulent, dangerous, insulting or unlawful behaviour may result in the suspension or deletion of the account.
7. Driver account
A driver registered on GotoGo acts as an independent professional.
The driver is solely responsible for complying with the legal, administrative, tax, social and professional obligations related to his or her activity.
The driver must notably be compliant regarding:
- his or her professional identity;
- his or her driving licence;
- any required transport authorisations;
- his or her professional insurance;
- the technical inspection or vehicle inspection certificate;
- the medical examination if required;
- the registration, condition and compliance of the vehicle;
- his or her tax, social and administrative obligations.
8. Driver documents
GotoGo may ask the driver to provide certain supporting documents before the activation or continued use of his or her account.
In the event of missing, expired, incorrect or non-compliant documents, GotoGo may refuse, suspend or deactivate the driver’s access to the platform.
9. Driver subscription
Driver access to the platform may be subject to a subscription.
The subscription remunerates access to the GotoGo digital tool and to the connection services. It does not constitute a commission on rides.
GotoGo may offer a launch offer allowing the driver to use the platform before the start of his or her subscription, notably up to a certain amount of rides completed.
As a launch offer, the driver subscription may only start after €500 excluding VAT of rides completed via the platform, according to the conditions communicated to the driver.
GotoGo reserves the right to modify, extend or withdraw this launch offer for new registrations.
10. No commission
GotoGo does not take any commission on rides carried out by drivers.
The driver keeps the amount paid directly by the customer, subject to his or her own costs, taxes, contributions or professional obligations.
11. Driver responsibility
The driver is solely responsible for the transport service that he or she agrees to carry out.
The driver is notably responsible for the safety of the ride, the compliance of the vehicle, his or her professional behaviour, the quality of the service provided and compliance with the applicable regulations.
GotoGo cannot be held liable for any breach, fault, delay, accident, damage or dispute directly related to the service carried out by the driver.
12. Customer responsibility
The customer is responsible for the information provided when making a ride request.
The customer undertakes to behave respectfully towards the driver and not to use the platform for unlawful, abusive or dangerous requests.
13. Account suspension or deletion
GotoGo reserves the right to suspend or delete a user or driver account in the event of:
- non-compliance with these terms;
- fraudulent, dangerous, abusive or unlawful behaviour;
- missing, expired or non-compliant driver documents;
- non-payment of a due subscription;
- damage to the image, safety or proper functioning of the platform.
14. Availability of the platform
GotoGo makes every effort to ensure the proper functioning of the website, application and platform.
However, GotoGo does not guarantee permanent, continuous or error-free access. Interruptions may occur for technical, maintenance, security or force majeure reasons.
15. Personal data
The use of GotoGo involves the processing of certain personal data.
The terms for collecting, using, storing and protecting personal data are described in the privacy policy available on the website.
16. Account deletion
Users may request the deletion of their account in accordance with the information provided on the dedicated page.
17. Intellectual property
The texts, visuals, logos, graphic elements, code, content and elements of the GotoGo platform are protected by copyright and intellectual property rights.
Any unauthorised reproduction, distribution, modification or use is prohibited.
18. Modification of the terms
GotoGo reserves the right to modify these terms of use at any time.
In the event of significant changes, users may be informed by any appropriate means, including via the website, the application or by email.
19. Applicable law
These terms of use are governed by Belgian law.
In the event of a dispute, the parties shall first attempt to find an amicable solution.
Failing an amicable solution, the competent courts shall be those of the jurisdiction of the publisher’s domicile or registered address, unless mandatory legal provisions provide otherwise.
